Introduction

Welcome to Amatsiko Tours! By using our website https://amatsikotours.com and booking tours with us, you agree to abide by these Terms and Conditions. Please read them carefully before making any bookings.

Booking and Payment

Booking

All bookings must be made through our website or directly with an authorised representative of Amatsiko Tours.

Payment

A 50% deposit is required to confirm your booking.

The remaining balance is due 30 days before arrival. If the final payment is not received by the due date (30 days before arrival), Amatsiko Tours reserves the right to cancel the booking without refund of the deposit. Late payments may be subject to additional fees or result in loss of booking.

Payments can be made via PayPal, bank transfer, credit card, or TransferWise. Any transaction fees are the responsibility of the customer.

Prices are in USD, and the customer is responsible for any currency conversion fees charged by their bank or payment provider.

Booking Confirmation

Once we receive your deposit, you will receive a booking confirmation email with details about your tour.

Prices and Charges

Prices listed on our website are in USD and are subject to change without notice. The price confirmed at the time of booking is final.

Additional charges may apply for optional activities or extra services requested during the tour. These charges will be communicated to you before confirming your booking.

Cancellations and Refunds

Cancellation by You

If you wish to cancel your booking, please notify us in writing as soon as possible. Refunds will be processed based on the following cancellation policy:

• 30+ days before departure: 90% refund

• 15-29 days before departure: 50% refund

• Less than 15 days: No refund

Cancellation by Us

Amatsiko Tours shall not be held responsible for cancellations or changes due to circumstances beyond our control, including but not limited to acts of nature, war, pandemics, strikes, government regulations, flight cancellations, or civil disturbances. In such cases, we will attempt to reschedule the tour or provide an alternative. If neither is possible, we may offer a refund at our discretion, subject to non-refundable costs already incurred.

Refunds, if applicable, will be processed within 14 business days via the original payment method.

Liability

Amatsiko Tours shall not be held liable for any injuries, damages, losses, or expenses arising from participation in tours, except in cases of gross negligence or willful misconduct. By booking, guests acknowledge that they travel at their own risk.

Guests further acknowledge that participation in tours involves inherent risks, including but not limited to wildlife encounters, rugged outdoor terrain, unpredictable weather conditions, and other natural hazards.

Amatsiko Tours is not liable for any losses, disruptions, or additional costs caused by force majeure events, including but not limited to natural disasters, civil unrest, strikes, pandemics, government actions, or transport failures.

Guests are responsible for ensuring they have appropriate travel insurance to cover potential risks, including medical emergencies, trip cancellations, and lost or damaged property.

Force Majeure

In the event of force majeure, Amatsiko Tours shall not be liable for any compensation, additional costs, or losses incurred by the guest. We will, where possible, assist in rescheduling but are under no obligation to provide refunds beyond what is recoverable from third-party suppliers.

Changes to Itineraries

Amatsiko Tours reserves the right to modify itineraries, accommodation, or transport arrangements due to unforeseen circumstances, including but not limited to safety concerns, adverse weather conditions, government restrictions, supplier availability, or operational requirements.

Any such changes will be communicated as early as possible, and we will make reasonable efforts to provide an equivalent alternative. If changes result in significant alterations to the experience, we will attempt to offer an alternative of equal or greater value.

However, Amatsiko Tours shall not be responsible for compensating guests for any expenses, losses, or inconvenience resulting from itinerary changes, including but not limited to missed flights, visa fees, accommodation adjustments, or personal costs incurred due to modifications.

Responsibilities and Conduct

Your Responsibilities

You are responsible for ensuring that you have valid travel documents (e.g., passport, visa) and for arriving at the meeting point at the scheduled time.

Conduct During the Tour

We ask that all guests respect local customs and follow the guidance of our tour leaders and local hosts. We reserve the right to remove anyone from the tour whose behaviour is disruptive or endangers others.

Personal Belongings

While we take reasonable security measures, guests are responsible for safeguarding their personal belongings. Amatsiko Tours is not responsible for items left unattended in vehicles, accommodations, or public spaces during the tour.

Health and Safety

Travel Insurance

All guests are strongly encouraged to obtain comprehensive travel insurance covering medical expenses, trip cancellations, personal liability, and lost or damaged belongings. Amatsiko Tours shall not be responsible for any costs incurred due to a guest’s failure to secure adequate insurance.

Health Requirements

Some tours may involve physical activity. It is your responsibility to ensure that you are in good health and fit for the tour. We reserve the right to deny participation if we believe a guest’s health may be at risk.

Photography & Media Use

We may take photos and videos during our tours for promotional purposes, including use on our website, social media, and marketing materials. If you prefer not to be photographed or included in such media, please notify us in writing before the tour begins by emailing info@amatsikotours.com. We will make reasonable efforts to respect your request.

Privacy Policy

Your privacy is important to us. We handle your personal information in accordance with our Privacy Policy. By using our website and booking a tour, you agree to our Privacy Policy.

Changes to Terms and Conditions

We reserve the right to update or modify these Terms and Conditions at any time. Any changes will be posted on this page, and the new terms will apply to all bookings made after the update.

Governing Law

These Terms and Conditions are governed by the laws of Uganda. Any disputes arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Uganda.

Dispute Resolution

In the event of a dispute, both parties agree to first attempt to resolve the matter through good faith negotiations. If a resolution cannot be reached within 30 days, the dispute shall be referred to mediation under a recognised mediation service in Uganda.

If mediation is unsuccessful, the dispute shall be exclusively governed by the laws of Uganda and resolved through litigation in the courts of Uganda.

By booking with Amatsiko Tours, guests expressly agree that no legal action shall be pursued outside of Uganda, and Amatsiko Tours shall not be subject to the jurisdiction of any foreign courts.
